Day 245: The Poisoner’s Handbook



Until the early nineteenth century few tools existed to detect a toxic substance in a corpse. Sometimes investigators deduced poison from the violent sickness that preceded death, or built a case by feeding animals a victim’s last meal, but more often than not poisoners walked free. As a result murder by poison flourished. It became so common in eliminating perceived difficulties, such as a wealthy parent who stayed alive too long, that the French nicknamed the metallic element arsenic poudre de succession, the inheritance powder.

The chemical revolution of the 1800s changed the relative ease of such killings. Scientists learned to isolate and identify the basic elements and the chemical compounds that define life on Earth, gradually building a catalog, The Periodic Table of the Elements. In 1804, the elements palladium, cerium, iridium, osmium, and rhodium were discovered; potassium and sodium were isolated in 1807; barium, calcium, magnesium, and strontium in 1808; chlorine in 1810. Once researchers understood individual elements they went on to study them in combination, examining how elements bonded to create exotic compounds and familiar substances, such as the sodium-chlorine combination that creates basic table salt (NaCl).

The pioneering scientists who worked in elemental chemistry weren’t thinking about poisons in particular. But others were. In 1814, in the midst of this blaze of discovery, the Spanish chemist Mathieu Orfila published a treatise on poisons and their detection, the first book of its kind. Orfila suspected that metallic poisons like arsenic might be the easiest to detect in the body’s tissues and pushed his research in that direction. By the late 1830s the first test for isolating arsenic had been developed. Within a decade more reliable tests had been devised and were being used successfully in criminal prosecutions.

But the very science that made it possible to identify the old poisons, like arsenic, also made available a lethal array of new ones. Morphine was isolated in 1804, the same year that palladium was discovered. In 1819 strychnine was extracted from the seeds of the Asian vomit button tree (Strychnos nux vomica). The lethal compound coniine was isolated from hemlock the same year. Chemists neatly extracted nicotine from tobacco leaves in 1828. Aconitine—described by one toxicologist as “in its pure state, perhaps the most potent poison known”—was found in the beautifully flowering monkshood plant in 1832.

And although researchers had learned to isolate these alkaloids—organic (carbon-based) compounds with some nitrogen mixed in—they had no idea how to find such poisons in human tissue. Orfila himself, conducting one failed attempt after another, worried that it was an impossible task. One exasperated French prosecutor, during a mid-nineteenth-century trial involving a morphine murder, exclaimed: “Henceforth let us tell would-be poisoners; do not use metallic poisons for they leave traces. Use plant poisons . . . Fear nothing; your crime will go unpunished. There is no corpus delecti [physical evidence] for it cannot be found.”

So began a deadly cat and mouse game—scientists and poisoners as intellectual adversaries. A gun may be fired in a flash of anger, a rock carelessly hurled, a shovel swung in sudden fury, but a homicidal poisoning requires a calculating intelligence. Unsurprisingly, then, when metallic poisons, such as arsenic, became detectable in bodies, informed killers turned away from them. A survey of poison prosecutions in Britain found that, by the mid-nineteenth century, arsenic killings were decreasing. The trickier plant alkaloids were by then more popular among murderers.

In response, scientists increased their efforts to capture alkaloids in human tissue. Finally, in 1860, a reclusive and single-minded French chemist, Jean Servais Stas, figured out how to isolate nicotine, an alkaloid of the tobacco plant, from a corpse. Other plant poisons soon became more accessible and chemists were able to offer new assistance to criminal investigations. The field of toxicology was becoming something to be reckoned with, especially in Europe.

The knowledge, and the scientific determination, spread across the Atlantic to the United States. The 1896 book Medical Jurisprudence, Forensic Medicine and Toxicology, cowritten by a New York research chemist and a law professor, documented the still-fierce competition between scientists and killers. In one remarkable case in New York, a physician had killed his wife with morphine and then put belladonna drops into her eyes to counter the telltale contraction of her pupils. He was convicted only after Columbia University chemist Rudolph Witthaus, one of the authors of the 1896 text, demonstrated the process to the jury by killing a cat in the courtroom using the same gruesome technique. There was as much showmanship as science, Witthaus admitted; toxicology remained a primitive field of research filled with “questions still unanswerable.”

In the early twentieth century industrial innovation flooded the United States with a wealth of modern poisons, creating new opportunities for the clever poisoner and new challenges for the country’s early forensic detectives. Morphine went into teething medicines for infants; opium into routinely prescribed sedatives; arsenic was an ingredient in everything from pesticides to cosmetics. Mercury, cyanide, strychnine, chloral hydrate, chloroform, sulfates of iron, sugar of lead, carbolic acid, and more, the products of the new chemistry stocked the shelves of doctors’ offices, businesses, homes, pharmacies, and grocery stores. During the Great War poison was established as a weapon of warfare, earning World War I the name “The Chemist’s War.” And with the onset of Prohibition a new Chemist’s War raged between bootleggers and government chemists working to make moonshine a lethal concoction. In New York’s smoky jazz clubs, each round of cocktails became a game of Russian roulette.

There was no way for the barely invented science of toxicology to keep up with the deluge. Though a few dogged researchers were putting out manuals and compiling textbooks on the subject, too many novel compounds had yet to be analyzed and most doctors had little or no training in the subject.

In 1918, however, New York City made a radical reform that would revolutionize the poison game and launch toxicology into front-page status. Propelled by a series of scandals involving corrupt coroners and unsolved murders, the city hired its first trained medical examiner, a charismatic pathologist by the name of Charles Norris. Once in office, Norris swiftly hired an exceptionally driven and talented chemist named Alexander Gettler and persuaded him to found and direct the city’s first toxicology laboratory.

Together Norris and Gettler elevated forensic chemistry in this country to a formidable science. Trailblazing scientific detectives, they earned a respected place in the courtroom, crusaded against compounds dangerous to public health, and stopped a great many Jazz Age poisoners in their tracks. As they determinedly countered the obstacles faced in each new case they developed innovative laboratory methods for teasing toxins from human tissue. Their scientific contribution became a legacy for future generations.

But this story begins before Charles Norris or Alexander Gettler took office, before forensic toxicology was considered a fully legitimate science. It begins in the gray of a frozen January in the city, when an unlikely serial killer decided to make his move in the poison game.

Day 113: Book Excerpt: Blood On The Tracks


The Murder of Thomas Briggs

Where better to start than with the first murder on a moving train in Britain? This provoked what – up to then – was the greatest manhunt in British legal history.

You have to imagine Mr Thomas Briggs. He was an aldermanic figure, the epitome of Victorian middle-class respectability. In 1864 he was sixty-nine years of age, tallish, silver-haired, immaculately dressed and sporting a flowing white beard. Altogether, he was a most distinguished-looking gentleman. He was the chief clerk of Robarts, Lubbock & Co., a banking house in the City of London, a position which he had only obtained through a long career of diligent duty and unassailable probity.

He was wearing the kind of clothes he normally wore when travelling to and from work. These included a distinctive high silk hat. He also had an expensive-looking gold chain stretched across his capacious midriff, the chain being attached to a fine gold watch in his waistcoat pocket. He carried a bag in one hand, and a stout walking stick in the other.

On 9 July 1864, a Saturday, he left the office around half-past four and travelled to Peckham, south of the Thames, for dinner with his niece and her husband. Briggs was a widower and he made the pilgrimage to No.23 Nelson Square, now Furley Road, every week. They ate well. They always did. It was still light at half-past eight when he left, his bag now empty because its contents had consisted of little presents for the niece of whom he was very fond. He boarded a horse-bus back to King William Street in the City. He then walked briskly (that was his way; he was very fit and strong for his age), to Fenchurch Street station where he climbed into a first-class compartment on a train of the North London Railway.

He caught the train with a couple of minutes to spare but no one else joined him in the compartment at Fenchurch Street. The train pulled out five minutes late at 9.50p.m. to start the roundabout route to his destination at Hackney via Shadwell, Stepney and Bow. Much of the route ran on low viaducts which gave a bird’s eye view of the rooftops of poor inner-city housing and the myriad of small, often rather noxious, industrial premises and workshops then so characteristic of that part of London’s East End. Hackney, however, was a cut above, boasting a respectable gentility.

The North London Railway had only just over thirteen miles of its own line, but its trains also ran on over fifty miles of line belonging to other companies. The North London Railway had an importance out of all proportion to its size because its small network linked the main lines coming into London from the north and west with the City and with the docks in the east. Its first London terminus was at Fenchurch Street via the circuitous route taken by the train conveying Briggs, but later it opened up services running more directly into the Broad Street terminus. This was a substantial station adjacent to Liverpool Street and which stood where the Broadgate development now is.

It may have been a small company but it was a proud one, and it had little time for the lower end of the travel market. Until 1875 it only catered for first and second-class passengers. It possessed a fleet of small but powerful 4-4-0 tank engines and its four-wheeled carriages were quite luxurious by the standards of the time.

It was a warm evening and almost totally dark as the train trundled along. A weak light in the ceiling provided only partial illumination. Briggs had worked all day, had eaten well, and was dozing fitfully. At Bow he exchanged brief pleasantries through his open carriage window with an acquaintance called Lee, who later averred that there were two other passengers in the compartment. One he described as thin and dark, the other as stoutish, thickset and lightly whiskered. Lee remembered being mildly surprised to see Briggs travelling at such a late hour. He was also surprised by the appearance of the other occupants of the carriage; they did not look like first-class passengers. Later, when he was in the witness box, he admitted that he had had a drink or two in a local pub. The general feeling in court was that ‘a drink or two’ actually meant several, or even many, drinks.

The train pulled out of Bow, being due to arrive at the next stopping place, Victoria Park, Hackney Wick, in a few minutes. The train was now four minutes behind time. The next compartment to that occupied by Briggs was also first class and was occupied by a draper called Withall and a female traveller. They were not together. As the train was approaching Hackney, Withall described how he heard a sudden and strange howling noise, reminiscent of a dog in distress. His unknown female companion made a remark to the same effect. In another compartment close by, a female passenger had the unpleasant experience of being spattered with drops of blood that came in through the open window. She later said that she had heard no untoward noises.

When the train arrived at Hackney, two young men-about-town, Henry Verney and Sydney Jones, were waiting to join the train to travel to Highbury, and they stepped into the compartment in which Briggs had started his journey. It was empty but, although it was very poorly lit, they soon realised that a lot of blood was scattered around the compartment. A number of personal items could be seen. These were a black leather bag and a walking stick. Under the seat lay a black beaver hat, so squashed that it looked as if someone had stood on it. Thoroughly alarmed, they managed to get the attention of the guard who directed them to another compartment.

The guard was intensely irritated by this turn of events. The train was already late and the North London Railway prided itself on the punctuality of its trains. He gave the compartment a quick visual going-over, enough to make it obvious to him that it had very recently witnessed foul play. He locked the compartment and gave instructions for a telegraph message to be sent to the superintendent at Chalk Farm, the station where the train terminated. There the carriage was uncoupled and shunted into a siding to await examination by the police.

Meanwhile the driver of a train proceeding in the opposite direction saw a dark object lying close to the track near the bridge over the ‘Duckett Cut’. This waterway, more correctly known as Sir George Duckett’s Canal, joined the Lea Navigation to the Regents Canal at Old Ford. It had opened in 1830. The train was brought to a halt and the guard, engine driver and firemen all descended to track level to investigate. They found that the object was the body of a man, battered, bloodied and still alive, although only just.

With considerable difficulty, they carried him down to the street where they were fortunate to encounter a police officer going around his beat. He summoned assistance and a doctor was soon on the scene. His initial impression was that the injuries on the left-hand side of the man’s head had probably been sustained by his fall from a train. However, two violent blows had fractured his skull. Briggs’s inert body was first of all taken to a nearby pub which did unusually good trade as the news got around. It was later transported to his home in Clapton Square where he died late the next evening. He never regained consciousness.

This horrible murder stirred up a hornets’ nest of outraged headlines and articles in the newspapers. ‘Murder on the Iron Way’ thundered one newspaper truthfully, while another, tending more to hyperbole asked, ‘Who is safe? If we may be murdered thus we may be slain in our pew at church, or assassinated at our dinner table’. This first railway murder emphasised just how vulnerable passengers in compartments could be to the depredations of malefactors, even in the biggest city in the world.

Day 65 : Book Excerpt : The Better Angels Of Our Nature

If the past is a foreign country, it is a shockingly violent one. It is easy to forget how dangerous life used to be, how deeply brutality was once woven into the fabric of daily existence. Cultural memory pacifies the past, leaving us with pale souvenirs whose bloody origins have been bleached away. A woman donning a cross seldom reflects that this instrument of torture was a common punishment in the ancient world; nor does a person who speaks of a whipping boy ponder the old practice of flogging an innocent child in place of a misbehaving prince. We are surrounded by signs of the depravity of our ancestors’ way of life, but we are barely aware of them. Just as travel broadens the mind, a literal-minded tour of our cultural heritage can awaken us to how differently they did things in the past.

In a century that began with 9/11, Iraq, and Darfur, the claim that we are living in an unusually peaceful time may strike you as somewhere between hallucinatory and obscene. I know from conversations and survey data that most people refuse to believe it.1 In succeeding chapters I will make the case with dates and data. But first I want to soften you up by reminding you of incriminating facts about the past that you have known all along. This is not just an exercise in persuasion. Scientists often probe their conclusions with a sanity check, a sampling of real-world phenomena to reassure themselves they haven’t overlooked some flaw in their methods and wandered into a preposterous conclusion. The vignettes in this chapter are a sanity check on the data to come.

What follows is a tour of the foreign country called the past, from 8000 BCE to the 1970s. It is not a grand tour of the wars and atrocities that we already commemorate for their violence, but rather a series of glimpses behind deceptively familiar landmarks to remind us of the viciousness they conceal. The past, of course, is not a single country, but encompasses a vast diversity of cultures and customs. What they have in common is the shock of the old: a backdrop of violence that was endured, and often embraced, in ways that startle the sensibilities of a 21st-century Westerner.

In 1991 two hikers stumbled upon a corpse poking out of a melting glacier in the Tyrolean Alps. Thinking that it was the victim of a skiing accident, rescue workers jackhammered the body out of the ice, damaging his thigh and his backpack in the process. Only when an archaeologist spotted a Neolithic copper ax did people realize that the man was five thousand years old.

Ötzi the Iceman, as he is now called, became a celebrity. He appeared on the cover of Time magazine and has been the subject of many books, documentaries, and articles. Not since Mel Brooks’s 2000 Year Old Man (“I have more than 42,000 children and not one comes to visit me”) has a kilogenarian had so much to tell us about the past. Ötzi lived during the crucial transition in human prehistory when agriculture was replacing hunting and gathering, and tools were first made of metal rather than stone. Together with his ax and backpack, he carried a quiver of fletched arrows, a wood-handled dagger, and an ember wrapped in bark, part of an elaborate fire-starting kit. He wore a bearskin cap with a leather chinstrap, leggings sewn from animal hide, and waterproof snowshoes made from leather and twine and insulated with grass. He had tattoos on his arthritic joints, possibly a sign of acupuncture, and carried mushrooms with medicinal properties.

Ten years after the Iceman was discovered, a team of radiologists made a startling discovery: Ötzi had an arrowhead embedded in his shoulder. He had not fallen in a crevasse and frozen to death, as scientists had originally surmised; he had been murdered. As his body was examined by the the CSI Neolithic team, the outlines of the crime came into view. Ötzi had unhealed cuts on his hands and wounds on his head and chest. DNA analyses found traces of blood from two other people on one of his arrowheads, blood from a third on his dagger, and blood from a fourth on his cape. According to one reconstruction, Ötzi belonged to a raiding party that clashed with a neighboring tribe. He killed a man with an arrow, retrieved it, killed another man, retrieved the arrow again, and carried a wounded comrade on his back before fending off an attack and being felled by an arrow himself.
